TRIBUNEWS.COM, JAKARTA – The defendant in the alleged defamation case of ‘Lord Luhut’, Haris Azhar, assessed that there were hidden legal facts from the panel of judges of the East Jakarta District Court when they decided to dismiss his objection in the case.

The fact that Haris said the judge tried to hide is that Komnas HAM’s opinion has not been read regarding the alleged human rights violations in the case that is currently being dragged against him and Fatia Maulidiyanti.

“If Komnas HAM’s opinion is related to allegations of human rights violations, then it should be heard and passed on by the jury,” Haris told reporters at the East Jakarta District Court on Monday (22/5/2023).

“Unfortunately the jury didn’t read it, so I’m saying there is a legal fact that was withheld from the jury,” he continued.

According to Haris, Komnas HAM’s opinion regarding the alleged human rights violations should be taken into account by judges when deciding a case in court.

However, the judges did not, even though Haris said that the opinion on human rights violations was issued by Komnas HAM, which is actually a legitimate state institution.

“This should have been considered but it was not, so legally and essentially the jury rejected the opinion of a state institution called Komnas HAM,” he said.

The judge rejects the objection of Fatia and Haris Azhar

The Panel of Judges of the East Jakarta District Court decided to dismiss the objection or objection filed by defendant Fatia Maulidiyanti regarding the alleged defamation case of Coordinating Minister for Maritime Affairs Luhut Binsar Pandjaitan.

This was stated by Chairman of the Panel of Judges at East Jakarta District Court, Cokorda Gede Arthana, reading the interim decision in the continuation of Haris Azhar’s trial at East Jakarta District Court, on Monday (22/5/2023).

“The trial held that defendant counsel’s objection was unacceptable,” the judge said in his decision.

After not receiving any objection from Fatia, the Judge ordered to continue the examination of the criminal case of Haris Azhar with registration number 203/Pidsus/2023/PNJaktim.

“As well as deferring the court costs until the final decision,” he said.
